1 Application & agreement
1.2 Shelican Solutions only supplies products to customers who have agreed to the terms and conditions.

1.3 Dutch law applies to these terms and conditions.

1.4 Shelican Solutions is authorized to change the terms and conditions at any time without notice.

1.5 The agreement starts when the confirmation email of the order is sent.

1.6 If a part of the agreement is not legally valid, this does not affect the validity of the rest of the agreement.

1.7 Shelican Solutions expects the customer to provide all truthful information on registration; payment information should be accurate and belong to the registering individual, unless it pertains to someone under the customer’s custody or guardianship.

1.8 Shelican Solutions will never send any marketing-related emails without an unsubscribe button. Marketing emails will only be sent with prior permission from the customer; unsolicited messages will not be sent.

2. Delivery & obligations
2.1 Shelican Solutions aims to deliver the product within 24 hours, unless stated otherwise in the product description.

2.2 Shelican Solutions delivers products only if the corresponding invoice is marked as paid.

2.3 Shelican Solutions guarantees that the product meets the specifications and conditions stated in the offer.

3. Payments & invoicing
3.1 We use the payment term indicated on the invoice unless agreed otherwise.

3.2 Services might not be activated automatically after payment verification.

3.3 The purchased service is automatically suspended when this service is overdue.

3.4 The right of withdrawal begins upon activation of the service and lasts for 14 days.

3.5 The right of withdrawal is only legally valid if the procedure takes place via means of communication stated in Article 10 paragraph 1 with the exception of means of communication 2, 3, and 5.

3.6 The right of withdrawal is only legally valid if the procedure is via Shelican Solutions and not through third parties.

3.7 The right of withdrawal is not valid on custom spec to-order services, such as but not limited to custom dedicated servers and custom VPS products.

3.8 The right of withdrawal is not valid for business customers.

4. Intellectual property
4.1 Images, illustrations, texts, video(fragments), etc. on all platforms of Shelican Solutions are only indicative and cannot be used as a result of a termination of an agreement or return of payment.

4.2 Copyright applies to all images, illustrations, texts, video (fragments), and other visual aspects.

5. Liability
5.1 Shelican Solutions is not liable for damages resulting from service interruptions or maintenance.

5.2 The maximum liability will never exceed the value of the service.

6. Force majeure
6.1 Force majeure means errors of suppliers of Shelican Solutions, interruptions, malfunctions, (terrorist) attacks, fire, water damage, internal problems, licensing problems, DDoS attacks, and problems in the business operations of third parties.

6.2 If the force majeure situation lasts longer than 30 days and after 30 days still affects the service, both parties are entitled to terminate the agreement. Reimbursement does not apply in any situation.

7. Technical
7.1 The servers of Shelican Solutions are located in various data centers such as but not limited to: Equinix AM5 Amsterdam, Evocative EWR1 New York, and Nikhef Housing Amsterdam.

7.2 Shelican Solutions performs irregular backups and is not obligated to provide regular backups or restore data.

7.3 Maintenance work may occur without prior notice, and interruptions due to maintenance is not considered downtime unless agreed upon in our SLA.

7.4 At the time of excessive use of a service, Shelican Solutions is authorized to suspend the service or charge an additional invoice for the costs incurred.

8. Pricing
8.1 All prices indicated on the internet site or communication platforms of Shelican Solutions are only indicative and subject to printing, typesetting, and spelling errors. The indicated price does not affect the validity of the agreement.

8.2 When Shelican Solutions adjusts the prices of a product or service, this will be applied to the next invoice.

8.3 All prices on the internet site of Shelican Solutions exclude VAT for people outside The Netherlands.

8.4 All prices on the internet site of Shelican Solutions are in Euro.

8.5 Shelican Solutions is authorized to adjust prices if communicated to the customer at least 14 days in advance.

9. Use
9.1 It is prohibited to use Shelican Solutions’s services for activities that contravene Dutch law, such as but not limited to DDoS attacks, spreading defamatory messages, racism, hate speech.

9.2 Should Shelican Solutions determine that there is a potential for disruption, harm, or any other threat to the integrity of our services, the functioning of our computer systems or network, or that of third parties, especially due to activities such as hacking, denial of service attacks, exploitation of bugs, or vulnerabilities in the software of Shelican Solutions or that of third parties, Shelican Solutions reserves the right to implement any reasonable measures deemed necessary to mitigate or prevent such risks.

9.3 Shelican Solutions may recover damages from violations of these Terms of Use. You indemnify Shelican Solutions of all third-party claims related to damage resulting from a violation of these Terms of Use.

11. Definitions
11.1 “Customer” refers to the purchasing party, the person or legal entity who purchases a service from Shelican Solutions

11.2 “Shelican Solutions” is defined as the business entity registered under the trade name “Shelican Solutions” with Chamber of Commerce number 00000000, located at Rua da Estação Nº1, 2725-124, Lisbon, Portugal.

11.3 “Personnel” means everyone who is employed or hired by Shelican Solutions

11.4 “Management” refers to the individuals holding positions within the C-Suite of Shelican Solutions

Shelican Solutions also referred to as: SH, grants great importance to protecting your privacy, and (personal) data is therefore carefully processed and secured by us.
In this privacy statement, we explain which personal information we collect and use and for what purpose.

Processing of personal data
SH can process your data because you use our services; you provide this data to us yourself. For example, you can give us your contact details if you want to communicate with us if you wish to receive further information about our services, if you’re going to apply for a position within our organization or if you want to do business with us. We then process this personal data to perform our services and to inform you. Without this personal data, we cannot implement our services and to give you a position. We only use your data for the processing of your request.

We could also obtain information through a third party that indirectly relates to you. When we do that, we ask the relevant third party to guarantee that they have lawfully collected the information and that we have the right to obtain and use that information from them.

Besides, we are interested in data that provide us information about you something about the use of our website, for example, the number of visitors in a certain period, which countries our visitors come from, and which pages have the most views. For this, we can register your IP address and domain name. To adapt the facilities and functions to the user’s equipment, we also keep track of the type of browser you use to access our website. The information obtained is the property of SH.

Cookies from the American company Google also are placed on our website as part of the “Analytics” service. We use this service to keep track of and get reports on how visitors use our site. Google may provide this information to third parties if Google is legally required to do so, or insofar as these third parties process the information on Google’s behalf. We do not influence this.

Use of personal data
SH collects and uses your data to deliver the information, services, and services you have requested and to manage the website. SH can also use your data to keep you informed of the functions of SH. We can also use your data for conducting research and performing analyses to improve both our website and our services.

SH needs a legal basis to process your data. SH will process your data based on preparing grounds such as executing an agreement, based on a legal obligation or through your permission. In the case of consent, you have the right to withdraw it at any time.

All of our employees respect your privacy. The information and personal data are treated confidentially, also by third parties who are responsible for the security of your data storage and will not be used for purposes other than those stated.

Transfer to third parties
SH does not sell, rent, or lease its customer lists to third parties. SH will never provide your data disclose, without notice, except when required by law or in good faith belief that such action is necessary to:

  • comply with a legal request; or
  • to protect and defend the rights or property of SH; or
  • act under exigent circumstances to protect the personal safety of users of SH or the public.


However, the personal data you provide may, in some cases, be processed by third parties. For example, SH can hire a supplier to perform administrative and operational work to support our relationship with you. These suppliers are bound by contractual and other legal obligations to treat your data confidentially and to respect your privacy. They, therefore, only have access to the personal information they need to perform their work. If required, we will enter into a processing agreement with this third party.

Storage of personal data
The basic principle for storing personal information is that all data is not stored any longer than necessary. SH will, therefore, not store personal data for longer than is strictly necessary to realize the purposes for which the data are collected. Exceptions to this are the data that we must keep for longer because the law requires us to do so.

Security of personal data
SH ensures appropriate organizational, technical, and physical protection of your data. SH keeps the personal information you provide on computer servers secure in a controlled, secure environment, protected from unauthorized access, use or disclosure. Automated decision making SH does not make decisions based on automated processing about matters that can have (significant) consequences for people.

Your rights
You have, among other things, the right to information, inspection or rectification, deletion, processing limitation, or the right to data portability. If you want to make use of your rights, you can send a specified request to [email protected]. To ensure that you have made the demand for inspection, we request that you send a copy of your proof of identity with the application. Make in this copy the passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number, and Citizen service number (BSN) black. This is to protect your privacy. SH will respond to your request as quickly as possible, but in any case within four weeks.

Changing the privacy statement
This privacy statement can be changed. SH will occasionally update the privacy statement to reflect company and customer feedback. SH advises you to periodically review this statement to stay informed of how SH protects your information.
