Please read the Terms Of Service carefully before using our services.

1. Application & Agreement

  • 1.2 Shelican only supplies products to customers who have agreed to the terms and conditions.
  • 1.3 Dutch law applies to these terms and conditions.
  • 1.4 Shelican is authorized to change the terms and conditions at any time without notice.
  • 1.5 The agreement starts the moment the customer receives an (whether or not automatically generated) email containing the confirmation of the order.
  • 1.6 If a part of the agreement is not legally valid, this does not affect the validity of the rest of the agreement.
  • 1.7 Shelican expects the customer to provide all information provided on registration if payment is completely truthful and is only your own unless you have custody or parenthood of the person you are registering for.
  • 1.8 Shelican will never send any marketing related emails without containing a unsubscribe button, Shelican also never sends any marketing emails without prior permission from the customer, Shelican will also never send any unsolicited messages.


2. Delivery & Obligations

  • 2.1 Shelican tries to deliver the product within 24 hours as far as possible, unless stated otherwise in the product description.
  • 2.2 Shelican delivers products only if the corresponding invoice is marked as paid.
  • 2.3 Shelican guarantees that the product meets the specifications and conditions stated in the offer.


3. Payments & Invoicing

  • 3.1 We use the payment term indicated on the invoice unless agreed otherwise.
  • 3.2 Services are activated at the time of payment verification. This process is automated.
  • 3.3 The purchased service is automatically suspended when an invoice is not paid.
  • 3.4 The right of withdrawal starts at the time of activation of the service and lasts 14 days.
  • 3.5 The right of withdrawal is only legally valid if the procedure takes place via means of communication stated in Article 10 paragraph 1 with the exception of means of communication 2, 3, and 5.
  • 3.6 The right of withdrawal is only legally valid if the procedure is via Shelican and not through third parties.
  • 3.7 The right of withdrawal is not valid on custom spec to order services, such as but not limited to custom dedicated servers, custom vps products.


4. Intellectual Property

  • 4.1 Images, illustrations, texts, video(fragments), etc. on all platforms of Shelican are only indicative and cannot be used as a result of a termination of an agreement or return of payment.
  • 4.2 Copyright applies to all images, illustrations, texts, video (fragments), and other visual aspects.


5. Liability

  • 5.1 Shelican is never liable for damage resulting from service interruptions or maintenance.
  • 5.2 Shelican is never liable for damage incurred by personnel of Shelican.


6. Force Majeure

  • 6.1 Force majeure means errors of suppliers of Shelican, interruptions, malfunctions, (terrorist) attacks, fire, water damage, internal problems, licensing problems, DDoS attacks, problems in the business operations of third parties.
  • 6.2 If the force majeure situation lasts longer than 30 days and after 30 days still affects the service, both parties are entitled to terminate the agreement. Reimbursement does not apply in any situation.


7. Technical

  • 7.1 The servers of Shelican are located various datacenters such as but not limited to: Equinix AM5, Cellnex Wormer, Cellnex Amsterdam, SmartDC Rotterdam, INAP New York, Cellnex ijsselstein, Nikhef Amsterdam.
  • 7.2 Shelican makes backups, but irregularly. Shelican is not required to make regular backups of services and cannot be required to restore backups.
  • 7.3 Shelican performs irregular maintenance of the services, both physically and remotely. Maintenance work does not have to be announced in advance. The interruption of working hours resulting from maintenance work is not regarded as downtime.
  • 7.4 Shelican is not liable for errors made by technical personnel.
  • 7.5 At the time of excessive use of a service, Shelican authorized to suspend the service or charge an additional invoice for the costs incurred.


8. Pricing

  • 8.1 All prices indicated on the internet site or communication platforms of Shelican are only indicative and subject to printing, typesetting, and spelling errors. The indicated price does not affect the validity of the agreement.
  • 8.2 When Shelican adjusts the prices of a product or service, this will be applied to the next invoice.
  • 8.3 All prices on the internet site of Shelican are in Euro and excluding vat.
  • 8.4 Shelican is authorized to adjust prices if communicated to the customer at least 14 days in advance.


9. Use

  • 9.1 It is not allowed to use the services of Shelican to be used for purposes that are contrary to Dutch law, such as DDoS attacks, spreading defamatory, defamatory, or hateful messages, racism, etc.
  • 9.2 As in the opinion of Shelican nuisance, damage, or other danger arises for the functioning of our services or the associated computer systems or the network of Shelican or third parties, in particular through hacking attempts, denial of service attacks, bug exploitation or leaks in the software of Shelican or third parties, Shelican is entitled to take all measures it reasonably considers necessary to avert or prevent this danger.
  • 9.3 Shelican may recover damages from violations of these Terms of Use. You indemnify Shelican of all third-party claims related to damage resulting from a violation of these Terms of Use.

11. Definitions

  • 11.1 “Customer” means the purchasing party, the person who purchases a service from Shelican.
  • 11.2 “Shelican” is understood to mean: the business operations of the company registered under the trade name “Shelican” under Chamber of Commerce number 000000, located at unknown location at this moment (Legalization in progress).
  • 11.3 “Personnel” means everyone who is employed by Shelican.
  • 11.4 “Management” means the officers of the position (s): Chief Executive Officer, Chief Operational Officer, Chief Financial Officer, System Administrator.

Privacy Statement
Shelican also referred to as: SN, grants great importance to protecting your privacy, and (personal) data
is therefore carefully processed and secured by us. In this privacy statement, we explain which personal
information we collect and use and for what purpose.

Processing of personal data
SN can process your data because you use our services; you provide this data to us yourself. For
example, you can give us your contact details if you want to communicate with us if you wish to receive
further information about our services, if you’re going to apply for a position within our organization or if
you want to do business with us. We then process this personal data to perform our services and to
inform you. Without this personal data, we cannot implement our services and to give you a position.
We only use your data for the processing of your request.

We could also obtain information through a third party that indirectly relates to you. When we do that,
we ask the relevant third party to guarantee that they have lawfully collected the information and that we
have the right to obtain and use that information from them.

Besides, we are interested in data that provide us information about you something about the use of our
website, for example, the number of visitors in a certain period, which countries our visitors come from,
and which pages have the most views. For this, we can register your IP address and domain name. To
adapt the facilities and functions to the user’s equipment, we also keep track of the type of browser you
use to access our website. The information obtained is the property of SN.

Cookies from the American company Google also are placed on our website as part of the “Analytics”
service. We use this service to keep track of and get reports on how visitors use our site. Google may
provide this information to third parties if Google is legally required to do so, or insofar as these third
parties process the information on Google’s behalf. We do not influence this.

Use of personal data
SN collects and uses your data to deliver the information, services, and services you have requested
and to manage the website. SN can also use your data to keep you informed of the functions of SN. We
can also use your data for conducting research and performing analyses to improve both our website
and our services.

SN needs a legal basis to process your data. SN will process your data based on preparing grounds
such as executing an agreement, based on a legal obligation or through your permission. In the case of
consent, you have the right to withdraw it at any time.

All of our employees respect your privacy. The information and personal data are treated confidentially,
also by third parties who are responsible for the security of your data storage and will not be used for
purposes other than those stated.

SN does not sell, rent, or lease its customer lists to third parties. SN will never provide your data disclose,
without notice, except when required by law or in good faith belief that such action is necessary to:
• comply with a legal request; or
• to protect and defend the rights or property of SN; or
• act under exigent circumstances to protect the personal safety of users of SN or the public.

However, the personal data you provide may, in some cases, be processed by third parties. For example,
SN can hire a supplier to perform administrative and operational work to support our relationship with
you. These suppliers are bound by contractual and other legal obligations to treat your data confidentially
and to respect your privacy. They, therefore, only have access to the personal information they need to
perform their work. If required, we will enter into a processing agreement with this third party.

Storage of personal data
The basic principle for storing personal information is that all data is not stored any longer than
necessary. SN will, therefore, not store personal data for longer than is strictly necessary to realize the
purposes for which the data are collected. Exceptions to this are the data that we must keep for longer
because the law requires us to do so.

Security of personal data
SN ensures appropriate organizational, technical, and physical protection of your data. SN keeps the
personal information you provide on computer servers secure in a controlled, secure environment,
protected from unauthorized access, use or disclosure.
Automated decision making
SN does not make decisions based on automated processing about matters that can have (significant)
consequences for people.

Your rights
You have, among other things, the right to information, inspection or rectification, deletion, processing
limitation, or the right to data portability.
If you want to make use of your rights, you can send a specified request to [email protected]. To
ensure that you have made the demand for inspection, we request that you send a copy of your proof
of identity with the application. Make in this copy the passport photo, MRZ (machine readable zone, the
strip with numbers at the bottom of the passport), passport number, and Citizen service number (BSN)

black. This is to protect your privacy. SN will respond to your request as quickly as possible, but in any
case within four weeks.

Changing the privacy statement
This privacy statement can be changed. SN will occasionally update the privacy statement to reflect
company and customer feedback. SN advises you to periodically review this statement to stay informed
of how SN protects your information.
